These Terms and Conditions ("Terms") govern your use of the Singularity Race mobile application (the "App"), operated by BeachDevLLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf, including the sections on in-app purchases.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, for your personal, non-commercial entertainment, in accordance with these Terms and Apple's App Store Terms of Service. This license is also subject to Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/.../stdeula. Where these Terms are stricter than the Apple Standard EULA, these Terms apply.
The App is free to download and play. Optional premium content ("Singularity Premium") is available through a single one-time purchase:
Prices are stated in U.S. dollars and may vary by region. The exact price will always be shown in the App Store payment sheet before you confirm a purchase.
a. Payment and Refunds
All purchases are processed by Apple through your Apple Account. We do not receive or store payment information and cannot issue refunds directly. Refund requests are handled by Apple under the App Store terms; you can request one at reports.apple.com. Except where required by law, all purchases are final.
b. Restoring Purchases
You can restore previous purchases on a new or reset device using the "Restore Purchases" option in the App's settings, while signed in to the same Apple Account used for the original purchase.
c. Changes to Pricing and Features
We may change the price or the features included in Singularity Premium in the future. Price changes will not affect a purchase already made, and Apple will notify you and, where required, ask you to consent before a price increase takes effect.
The App includes virtual items and currencies such as Legacy Points, trophies, in-game funds, and unlockable content ("Virtual Items"). Virtual Items:
Game progress is stored locally on your device. We are not responsible for loss of game progress resulting from deleting the App, device loss or failure, or device changes.
The App integrates with Apple's Game Center for optional leaderboards and achievements. Your use of Game Center is governed by Apple's terms. When participating in leaderboards, you agree not to submit scores obtained through cheating, exploits, or unauthorized modification of the App. We reserve the right to request removal of fraudulent scores.

The App, including its code, artwork, characters, text, design, gameplay systems, and all other content (excluding Apple and third-party components), is owned by BeachDevLLC and is protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved. "Singularity Race" and associated logos and artwork may not be used without our prior written permission.
Singularity Race is a work of interactive fiction and satire about a fictional race to artificial general intelligence. All companies, characters, events, and scenarios in the game are fictional. The game is provided for entertainment purposes only and does not constitute advice, prediction, or commentary about any real company, person, or technology.
We may release updates, patches, or new content at our discretion, and updates may be required to continue using the App. We may modify, suspend, or discontinue the App (or any feature of it) at any time. If the App is permanently discontinued, this does not entitle you to a refund for a lifetime purchase except where required by law or by Apple's policies.
These Terms are effective until terminated. Your rights under these Terms terminate automatically if you fail to comply with them. Upon termination, you must cease all use of the App and delete all copies. We may also terminate or suspend access to features (such as leaderboards) for violation of these Terms. Sections 4, 7, 8, 11, 12, 13, and 15 survive termination.
To the maximum extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that game data will never be lost.
To the maximum extent permitted by applicable law, in no event shall BeachDevLLC be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the App, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the App shall not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months preceding the claim, or (b) fifty U.S. dollars ($50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless BeachDevLLC and its owners, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the App.
These Terms are between you and BeachDevLLC only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. You acknowledge that:
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the App shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts. Nothing in this section deprives you of mandatory consumer protections in your country of residence.
We may update these Terms from time to time. When we do, we will revise the Effective Date above and, for material changes, provide notice within the App or on this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the Apple Standard EULA and our Privacy Policy, constitute the entire agreement between you and us regarding the App.
